HOW TO CITE ON THIS EXAM:

You should cite when you use class notes, class texts, or refer to allowed web sites.   It is adequate to cite for example as follows:  (Anderson, p. 74), (Nutshell, pp. 45), (class notes, 1/15), or (insert web site address URL here).  I take off many points for no or too few citations!  You do not need any sort of bibliography or works cited. This simple internal citation means that I can pinpoint where you are getting your sources.  I already know which sources you are referring to as you may only use course materials.

Chapter three

1) What (and when) was the Termination Era? What (and when) was/is the Self-Determination Era? Discuss the Self-Determination Era with and without Termination. HINT: This refers to policy before and after President Nixon’s Special Message on Indian Affairs. Make sure to use citations as discussed above. 2) This question shows me that you have synthesized law. (This means that you have analyzed cases and other law to explain sets of rules about the law.) You should use pages 210-251 in you Anderson casebook. Make sure to include the Tee-Hit-Ton, US v. Sioux Nation, Mitchell, and Cobell cases to answer this question. (You do not have to tell me what each case is about, but you DO have to put them into context where they are relevant.)  What can we learn about “Federal Taking of Tribal Property?” What did you learn about “Relief for Breach of Trust Responsibility?” HINT ONE: Make sure you also include the relevant United States Code (U.S.C.) sections in your discussion. HINT TWO: Your Nutshell may be able to help you if you get stuck.  Make sure to use citations as discussed above.  Make sure to answer each and every part of this question.  20 points—one (1) page minimum—This means a FULL (not partial) page with STANDARD spacing as described above.

4) What is Indian Country? (You do not have to summarize them, but make sure to include the Solem, Hagen, and Yankton Sioux Tribe cases in your discussion.) 5) What is Tribal Sovereignty?  Why is it important?  10 points—one-half page (.5) page minimum.

Chapters nine and ten

6) What are usufructuary rights?  Why are they significant to this course?  What natural resources are most relevant to Native Peoples?  Why?  Now pick any one case that we have studied relating to natural resources and briefly explain the facts and the court’s holding (decision) for it. You MAY use a water rights case here even if it is in a different chapter from the other natural resources that you are discussing.   10 points—one-half page (.5) page minimum.
