This delayed the contractor by 1 week with the work programme for Flats 1&2. They had to be adapted to make them fit the space. This delayed the contractor by 1 week with the work programme for Flats 1&2. The kitchens for Flats 3-8 had not been ordered when the problem with the first ones was discovered so the order for the remaining kitchens was altered. This meant that the new ones arriving for Flats 3-8 did fit. The work programme had been delayed by 1 week while the kitchens were adapted to fit. When the plumbers arrived to do their work on the kitchens in week 3 as planned, the kitchens were not ready for the plumbing work. The plumbers could not work with the delay because they had another job scheduled so they left the site. The plumbers were able to return in week 6, by which time all the kitchens were ready. They did the plumbing work for all the flats in weeks 6 and 7. 3 This meant that the decorating that had been scheduled for Flats 1&2 in week 7 was delayed by a week while the plumbers worked. A1 Builders had planned to use the decorators to decorate Flats 1&2 then move onto Flats 3-8. The overall effect of all the delays caused the work to Flats 3-8 to be delayed by 2 weeks and so the whole programme was finally finished in week 10, although the work to Flats 1&2 was finished in week 8. In order for the decorators to complete the work in the timescale they had to work over a bank holiday weekend, which meant their labour costs were increased by 15%. This was an expense they could pass onto A1 Builders. Because the plumbing work was delayed it then coincided with the work being carried out to the stairs. While this work was being carried out the stairs could not be used. To avoid using the stairs A1 Builders had to hire a tower scaffold to give all the contractors access directly to the flats from the outside. The cost of having to provide this alternative means of access was £5000. A1 Builders have claimed a 2 week extension of time under clause 2.29.7 . Under clause 4.24.5 they have made a loss and expense claim in respect of £5000 for scaffold hire and £2500 for the decorators’ increased labour charge. Security Investments have claimed that under clause 4.23.2 and .3 A1 Builders have not provided all the details of their loss and expense claim to the contract administrator. They have given no details of how the figures are calculated and no information to substantiate their extension of time request. Bob Green, the contract administrator, believes it should have been possible to make up the time lost in other ways. The dispute has been referred to adjudication. You can assume the correct procedure has been followed. TASK You can either act on behalf of A1 Builders Ltd or Security Investments Ltd. You are called to appear before the Construction Adjudicator on Tuesday 2nd May to present your case. If you represent A1 Builders Ltd. you will need to explain the legal basis of your claim for an extension of time and for loss and expense, stating why you believe you are entitled to each of the claims. If you represent Security investments Ltd. you will need to explain the legal basis for opposing these two claims and setting out the arguments in favour of your case. You have 10 minutes to present your case and answer any questions the Adjudicator may have.
